<p>DID YOU KNOW-When a bankruptcy case is filed by or against a spouse while a divorce is pending, exclusive jurisdiction over the property of the debtor spouse (the <strong>bankruptcy</strong> estate) is automatically transferred to the bankruptcy court. See In re White, 851 F2d 170, 173 (6th Cir 1988).</p>
<p>The <strong>bankruptcy</strong> estate is created when the <strong>bankruptcy</strong> case is filed (whether filed voluntarily by the debtor or filed involuntarily against the debtor by creditors meeting the requirements of 11 USC 303). The <strong>bankruptcy</strong> estate consists of all property of the debtor. 11 USC 541 defines property of the estate very broadly; generally, it includes all property of the debtor “wherever located and by whomever held.” See 11 USC 541 discussed in §§17.5–17.6.</p>
<p>When a bankruptcy is filed by (or against) a spouse while a divorce case is pending in state court, the state court’s ability to take action against property of the debtor’s estate is automatically stayed or limited by 11 USC 362.</p>
<p>There are some exceptions to the automatic stay pertaining to family law matters, which are found in 11 USC 362(b)(2). Counsel for both the debtor and nondebtor should immediately take appropriate actions as discussed in §17.11. The nondebtor spouse may need to file a claim as discussed in §17.29.</p>
<p>Other sections of special note include §17.16 (domestic support obligations (DSOs)), §17.17 (non–DSO obligations), §17.20 (preferential transfers), §17.21 (fraudulent transfers), §17.26 (power to intervene), §17.27 (pursue preferential transfers), §17.28 (sham divorces), §17.29 (proof of claim), and §17.30 (drafting divorce judgments).</p>

<p><strong>Friday-Sunday:</strong> Mark your calendar for 3 fun-filled days in Clio for the first “Circus Park Extravaganza for Shrine Children.&#8221; This new festival has joined together with the “6th Annual Bikes and Bands for Shrine Children.&#8221; It featuresa full Carnival Midway by Schmidt Amusements. There will be a huge police escorted motorcycle ride that will leave Shiawassee Harley Davidson and tour 26 miles and end at Circus Park in Clio. Live entertainment on Friday and an all day music concert on Saturday featuring 10 bands in the entertainment tent. Also fireworks on Friday night, craft show/flea market, vendor alley and bike show. All proceeds benefit the Elf Khurafeh Shrine Center for Shrine Children. <p><strong>Friday through June 19: </strong>“Shakespeare in the Park” presents the romantic comedy “Love’s Labors Lost,” opening at Kearsley Park. The play is directed by Kay Kelly. The meeting is open to the public, and as such, all members of the College District are welcome to attend. <p><strong>Saturday:</strong> Flint and Genesee County will honor Mark Ingram with a homecoming celebration from noon-2 p.m. May 22 at Flint’s historic Atwood Stadium. Friends, family and fans will have an opportunity to cheer on the Alabama running back, Flint Southwestern Academy grad and former Grand Blanc student, for winning the Heisman Trophy and helping lead the Crimson Tide to a national championship.</p>
<p><strong>Saturday:</strong> Participants are invited to join the Flint Downtown Development Authority for a spring planting. The event will start with a continental breakfast at 8:30 a.m. on the Kearsley/Saginaw streets flat lot, followed by the planting project that will beautify Saginaw Street and parts of the Flint River Trail. <p><strong>Sunday:</strong> Foster Hope, an advocacy organization that raises funds to provide mentoring and life skills programs to foster children, is holding a carnival and motorcycle ride on Sunday, May 23 in downtown Flint. There will be vendor booths, raffles and more in the downtown flat lot at the corner of Kearsley Street and Saginaw near UM-Flint. The cost is $15 for a single rider and $20 for double riders, including a meal. The Carnival will run from 2-4 p.m. on the flat lot with carnival food, inflateables, a $1 bike raffle, face painting, games and performances by kids. The cost for kids is $3 and adults are free. Lino Tagliapietra in Retrospect: A Modern Renaissance in Italian Glass features 160 works by Lino Tagliapietra, the revered Venetian maestro of glassblowing. Louis Comfort Tiffany: Objects of Utility, Objects of Art includes 40 of the finest leaded glass lamps created by the foremost American glassmaker of the Twentieth Century. Lino Tagliapietra in Retrospect: A Modern Renaissance in Italian Glass features 160 works by Lino Tagliapietra, the revered Venetian maestro of glassblowing. Louis Comfort Tiffany: Objects of Utility, Objects of Art includes 40 of the finest leaded glass lamps created by the foremost American glassmaker of the Twentieth Century. <p><strong>May 31: </strong>The Grand Blanc Heritage Museum will hold its annual Memorial Day Open House Monday, May 31, 2010, from 10 AM until PM. <p>Language barriers. Cultural diversity. Suspicion about the government. They&#8217;re all part of the daunting challenge the Census Bureau faces in just 18 months to accurately tally the number of Americans.</p>
<p>Counting each person in the USA every 10 years hasn&#8217;t been easy since the first Census in 1790, when counters went door to door on horseback. But 220 years later, the hurdles could be unprecedented. The nation now has more than 300 million people. It&#8217;s more diverse than ever. Natural disasters such as hurricanes Katrina and Ike have displaced tens of thousands. Home foreclosures have put countless families into temporary living arrangements.</p>

<p>To count them, the Census Bureau first has to find them. Complicating the task is a widespread climate of suspicion about personal data landing in the wrong hands and government&#8217;s increased surveillance power. Much of the unease is engendered by the growing problem of identity theft and the 9/11 terrorist attacks.</p>
<p>New anti-terrorism measures such as the Patriot Act expanded the authority of law enforcement agencies here and abroad. The Census vows confidentiality, but new state and local laws that aim to crack down on undocumented immigrants are making even some legal immigrants nervous.</p>
<p>&#8220;It&#8217;s the first post-9/11 Census,&#8221; says Terri Ann Lowenthal, a legislative consultant for The Census Project, a coalition of groups eager for an accurate Census. &#8220;There&#8217;s a double issue: concern about immigrants and concern about privacy of data.&#8221;</p>

<p>The Census Bureau has to get past the distrust and break through a vast number of languages and cultures. At the same time, the agency is scrambling to satisfy congressional overseers upset over mounting costs of the 2010 Census — now estimated at $14 billion — and its failure to use more technology such as online filing and handheld computers to help gather data.</p>
